Know Your Rights under MAHARERA:
It is essential to know your rights as a buyer →  Section 19(1): Right to Obtain Information. →  Section 19(2): Right to know the Schedule. →  Section 19(3): Right to claim possession of the Property. →  Section 19(4): Right to claim Refund. →  Section 19(5): Right to claim Documents. →  The Defect Liability Period, also known as Home Warranty, has been set to 5 years from the date of possession under Clause 14 (3) of the Real Estate (Regulation and Development) Act, 2016 (RERA). When a Developer is liable to Pay Compensation (Buyers)? →  If the promoter is unable to give possession of an apartment. →  Due to discontinuance as a developer on account of suspension or revocation of the registration under this act. →  In such cases, if the allottee wishes to withdraw from the project. →  Where an allottee does not intend to withdraw from the project, they shall be paid, by the Builder/Developer, interest for every month of delay, till the handing over of the possession, at such a rate as may be prescribed.
As per the latest order issued by MahRERA, the entire amount can’t be forfeited by the developer on account of booking cancellation. The penalty amount is dependent on the number of days of the booking. Understanding these charges can help you make informed decisions. As per the orders: → Homebuyers will not be charged any amount for canceling within 15 days of booking. → 1 percent of the cost of the said unit between 16 days to 30 days. → 1.5 percent between 31 days to 60 days. → 2 percent for cancellation over 61 days.
